DOL issues new rule for high hazard industries

Beginning January 2024, the Occupational Safety and Health Administration is expanding the electronic reporting requirements for some high-hazard employers with 100 or more employees. This new requirement is in addition to previous electronic reporting of the employers 300A Work Related Illness and Injury Summary for employers with 20 to 249 employees. Previously, high-hazard employers with over 250 employees also had to report their 300A Summary Log to OSHA.

In the original electronic reporting mandate, high-hazard employers included the NAICS Utilities Sector 22 that covers Utility Generation, Transmission & Distribution, and Construction, and Sector 23 Utility Construction and Contractors with 250 or more employees.

The new requirement means to add the employers' 300 Log of Work Related Illness and Injuries, and the employers' 301 Illness and Injury Incident Reports applies to High Hazard employers listed in Appendix B of the new Final Rule. Appendix B does not appear to cover either electric utilities or utility construction employers.
